ORDINANCE NO. BL2003-1425


An ordinance authorizing the assumption and taking over by the Metropolitan Government of Nashville and Davidson County of all public functions, rights, duties and property, assets and liabilities connected with First Suburban Water Utility District of Davidson County and assuming service jurisdiction and the Metropolitan Mayor to execute the agreement (Proposal No. 2003M-075UG).

WHEREAS, T.C.A. Section 7-3-3-2(1) authorizes any metropolitan government created and established pursuant to Title 7 of the Tennessee Code Annotated to assume and take over all the public functions, rights, duties, property, assets and liabilities of any utility district, sanitary district, school district, or other public service district, all of whose public functions, services and duties are performed within the geographical jurisdiction of such metropolitan government; and,

WHEREAS, it is considered to be in the public interest to have uniform consolidated water utilities throughout the Metropolitan Government’s territorial jurisdiction.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the Mayor is authorized to execute the attached agreement with First Suburban Water Utility District located in Davidson County. Metropolitan Government officials are hereby authorized and directed to assume and take over all functions, rights, duties, property, assets and liabilities connected with the water distribution reservoirs and pumping facilities of the First Suburban Water Utility District.

Section 2: Any amendments to this legislation may be processed by resolution.

Section 3. This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
