An ordinance authorizing the Metropolitan Government to participate with the Cheatham County Rail Authority for the construction of Project No. 03-SG-50, a Box Culvert at Station 10+32 for access to Metro’s Whites Creek Pumping Station.

WHEREAS, Metro and the Cheatham County Rail Authority have agreed to participate in the cost of funding a box culvert at Station 10+32 needed for access to Metro Water Services’ Whites Creek Pumping Station; and,

WHEREAS, this participation agreement is deemed to benefit both parties and the general community; and,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of Water and Sewerage Services acting on behalf of the Metropolitan Government is hereby authorized to execute a participation agreement, Exhibit 1, with the Cheatham County Rail Authority to improve access to the Whites Creek Pumping Station, Project No. 03-SG-50.

SECTION 2. The Department of Water and Sewerage Services on behalf of the Metropolitan Government of Nashville and Davidson County agrees to pay the actual cost of the Box Culvert or an amount not to exceed $65,000.

SECTION 3. Any amendments to this legislation may be processed by resolution.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
