ORDINANCE NO. BL2003-1423


An ordinance authorizing the Metropolitan Government to participate with John Ring, Tennessee Contractors, Inc., to provide public sewer service in Williamson County to Fountainbrooke Phase 3, Project No. 03-SL-41.

WHEREAS, John Ring, Tennessee Contractors, Inc., has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Fountainbrooke Phase 3; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers; and

WHEREAS, it is deemed to benefit both parties and the general community, and John Ring, Tennessee Contractors, Inc., agrees to pay an amount not to exceed $64,000.00 for 32 single-family home connections; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Mayor of the Metropolitan Government is hereby authorized to execute a participation agreement, Exhibit 1, with John Ring, Tennessee Contractors, Inc., to provide public sewer services in Williamson County, Tennessee, known as Fountainbrooke Subdivision, Phase 3, Project No. 03-SL-41.

SECTION 2. That John Ring, Tennessee Contractors, Inc., agrees to pay an amount not to exceed $64,000.00, for a total of 32 single-family home connections.

SECTION 3. That the $64,000.00 is deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
