ORDINANCE NO. BL2003-1414


An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning a portion of 61st Avenue North from the CSX railroad tracks north to its terminus at the Cumberland River (Proposal No. 2003M-012U-07).


WHEREAS, It is the desire of all the abutting property owners that said abandonment be accomplished; and

WHEREAS, The closure has been requested by by Bill Herguth, Lafarge North America (Missouri Portland Cement Company), for Cone Solvents and Altivia Corporation, abutting property owners; and

WHEREAS, There is no future need for said portion of said street for Metropolitan Government purposes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. BL2002-1248, be and is hereby amended, as follows:

a portion of 61st Avenue North from the CSX railroad tracks north to its terminus at the Cumberland River, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, is hereby abandoned.

SECTION 2. BE IT FURTHER ENACTED, That the Director of the Department of Public Works be and is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 3. BE IT FURTHER ENACTED, That all easements within the area specified in Section 1 that are held by the Metropolitan Government of Nashville and Davidson County are hereby abandoned.

SECTION 4. BE IT FURTHER ENACTED, That the Director of the Department of Public Works be and is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 5. BE IT FURTHER ENACTED, That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1

To

Ordinance No. BL2003-1414

Mr. President:

I move to amend Ordinance No. BL2003-1414 as follows:

That Section 3 be amended by adding the following to the end of the sentence after the word “abandoned”:

“subject to the relocation of the existing utilities in the easement at the expense of the applicant and then the easement will be abandoned after the relevant department of the Metropolitan Government has accepted the relocated utilities.”
