ORDINANCE NO. BL2003-1412


An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning a portion of Alley #571 between Map 81-16, Parcels 422, 423, & 424 southwest of 14th Avenue North; relocating Alley #577 from Meharry Boulevard north to its terminus at Alley #571 approximately 23 feet towards 14th Avenue North; and abandoning a portion of an Unnamed Alley from Meharry Boulevard north to its terminus at Map 81-16 (Proposal No. 2003M-010U-08).


WHEREAS, It is the desire of all the abutting property owners that said abandonment be
accomplished; and

WHEREAS, The closure has been requested by Michael Delvizis, Stantec Consulting Services,
Inc., for Matthew Walker Comprehensive Health Center, Inc., abutting property owner; and

WHEREAS, There is no future need for said portion of said alleys for Metropolitan Government
purposes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Official Street and Alley Acceptance and Maintenance Map for
The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No.
BL2002-1248, be and is hereby amended, as follows:

a portion of Alley #571 between Map 81-16, Parcels 422, 423, & 424 southwest of 14th Avenue North and a portion of an Unnamed Alley from Meharry Boulevard north to its terminus at Map 81-16, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, are hereby abandoned. In addition, Alley #577 from Meharry Boulevard north to its terminus at Alley #571 is hereby relocated approximately 23 feet towards 14th Avenue North, in accordance with the attached sketch.

SECTION 2. BE IT FURTHER ENACTED, That all easements within the area specified in Section 1 that are held by the Metropolitan Government of Nashville and Davidson County are hereby abandoned.

SECTION 3. BE IT FURTHER ENACTED, That the Director of the Department of
Public Works be and is hereby authorized and directed, upon the enactment and approval of this
ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance,
and to make notation thereon of reference to the date of passage and approval of this amendatory
ordinance.

SECTION 4. BE IT FURTHER ENACTED, That this ordinance take effect from and
after its passage, the welfare of The Metropolitan Government of Nashville and Davidson
County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2003-1412

Mr. President:

I move to amend Ordinance No. BL2003-1412 as follows:

That Section 2 be amended by adding the following to the end of the sentence after the word "abandoned":

"subject to the relocation of the existing utilities in the easement at the expense of the applicant and then the easement will be abandoned after the relevant department of the Metropolitan Government has accepted the relocated utilities."
