ORDINANCE NO. BL2003-1409


An ordinance abandoning Ingress-Egress Driveway Easement, access to the Rolling Fork Reservoir, located on Map 129-05, Parcel 005, 006, 007, 008, and 009.00 of Project No. 02-SG-159, Hathaway Ct., (Proposal Nos. 2002M-125U-07 and 2003M-028U-07).


WHEREAS, the existing Ingress-Egress Driveway Easements shown on the map for No. 02-SG-159, Hathaway Ct., on record in the department of the Director of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easement and the Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment of said Ingress-Egress Driveway Easements on March 25, 2003, Proposal Nos. 2002M-125U-07 and 2003M-028U-07; and,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Ingress-Egress Driveway Easements shown on Map 129-05, Parcels 005, 006, 007, 008, 009, and shown on Project No. 02-SG-159, Hathaway Ct., Ingress-Egress Driveway Easement abandonment, are declared abandoned. The Director of Water and Sewerage Services or the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment contemplated by this ordinance.

SECTION 2: Any amendments to this legislation may be processed by resolution.

SECTION 3: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
