ORDINANCE NO. BL2003-1408


An ordinance authorizing the Director of Public Property, or his designee, to accept and record easements in favor of the Metropolitan Government, for the use in connection with development of the Stones River greenway system, and to close and abandon and execute to Mr. and Mrs. Gayron C. Lytle a quitclaim deed for the Metropolitan Government’s interest in an existing but unbuilt right-of-way (Proposal No. 2003M-044G-14).


Whereas, the owners (the “Donors”) of the parcel of property (the “Property”) described in the document attached as Exhibit A to this ordinance have agreed to donate to the Metropolitan Government an easement on the Property; and

Whereas, the easement will be used to construct, operate and maintain a portion of the greenway system; and

Whereas, the Metropolitan Government proposes to close, abandon and convey by quitclaim deed to the Donors such interest as the Metropolitan Government may have in an existing but unbuilt right-of-way across a portion of the Property as described in Exhibit B; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the donated easement and by conveying the referenced interest in the unbuilt right-of-way.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Director of Public Property, or his designee, is authorized to accept and record the greenway easement on the Property described in Exhibit A.

Section 2. The existing but unbuilt right-of-way shown on Exhibit B is hereby closed and abandoned.

Section 3. The Director of Public Property, or his designee, is authorized to execute the quitclaim deed attached as Exhibit B conveying such interest as the Metropolitan Government may have in an existing but unbuilt right-of-way across a portion of the Property.

Section 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
