ORDINANCE NO. BL2003-1404


An ordinance abandoning a portion of a 10” Sanitary Sewer and Easement located on Map 81-12, Parcel 300.00 of Project No. 02-SL-175, Buena Vista Elementary School Addition, as manhole will be installed over the exiting 10” sewer line to establish separation of public and private lines (Proposal No. 2003M-023U-08).


WHEREAS, Metropolitan Government of Nashville and Davidson County is the owner of real property where Buena Vista Elementary School is located that is encumbered by a 10” Sanitary Sewer and Easement; and,

WHEREAS, portions of the existing 10” Sanitary Sewer and Easement are no longer being used by the Department of Water and Sewerage Services, more particularly described on the map for Project No. 02-SL-175, Buena Vista Elementary School Addition, 10” Sanitary Sewer and Easement abandonment, on record in the office of the Director of Water and Sewerage Services, said map is made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services can abandon a portion of the existing 10” sewer line and easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment of this 10” Sanitary Sewer and Easement on February 27, 2003, Proposal No.2003M-023U-08.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the 10” Sanitary Sewer Line and Easement shown on Map 81-12, Parcel 300.00 of Project No. 02-SL-175, Buena Vista Elementary School Addition, copy attached, are declared abandoned, upon installation and acceptance by Metro Water and Sewerage Services of required manhole. Metropolitan Government agrees to abandon the existing sewer line and easement and the Director of Water and Sewerage Services or the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: Any amendments to this Legislation may be processed by Resolution.

SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
