ORDINANCE NO. BL2003-1402
An ordinance to abandon and accept a relocated 6” Water Line and Easement
on Map 93-04, Parcel 082.00 of Project No. 02-WL-162, M.D.H.A. Water Line
Abandonment and Relocation, (Proposal No. 2003M-024U-05).
WHEREAS, M.D.H.A. James
A. Cayce Homes is the owner of real property encumbered by a 6” Water
Line and Easement; and,
WHEREAS, portions of the existing 6” Water Line and Easement are no longer being used by the Department of Water and Sewerage Services, more particularly described on the map for Project No. 02-WL-162, M.D.H.A. Water Line Abandonment and Relocation, on record in the office of the Director of Water and Sewerage Services; and,
WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County approved the abandonment of this 6 “ Water Line and Easement on February 27, 2003, Proposal No. 2003M-024U-05.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the 6” Water Line and Easement shown on Map 93-04, Parcel 082.00 of Project No. 02-WL-162, M.D.H.A. Water Line Abandonment and Relocation, is declared abandoned, upon installation and acceptance by Metro Water and Sewerage Services of proposed relocationed water line and easement, noted on attached map. Metropolitan Government agrees to abandon the existing water line and the Director of Metro Water and Sewerage Services or the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment, acceptance, and relocation.
SECTION 2: Amendments to this Legislation may be processed by Resolution.
SECTION 3: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
