ORDINANCE NO. BL2003-1394


An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable to property located at 7585 Old Hickory Boulevard, abutting the north margin of Old Hickory Boulevard, (38.50 acres), classified within the R20 district and proposed for R8 district, the provisions of a Planned Unit Development District, to permit the development of 171 single-family lots (Proposal No. 2003P-002G-02).


NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By making applicable to property located at 7585 Old Hickory Boulevard, abutting the north margin of Old Hickory Boulevard, (38.50 acres), classified within the R20 district and proposed for R8 district, the provisions of a Planned Unit Development District, to permit the development of 171 single-family lots, as being part of Property Parcel No. 2 (38.50 acres) as designated on Map 41 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described by lines, words and figures on the attached plan, which is attached to and made a part of this ordinance as though copied herein.

Section 2. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 41 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.


Section 3. BE IT FURTHER ENACTED, That prior to the issuance of any final plats the following road conditions must be bonded or completed, and any request to change #5 shall require Metro Council action:

On the entrance roadway from Old Hickory Boulevard, provide one 14-foot entrance lane and two 12-foot exiting lanes for 150 feet north of the right-of-way line of Old Hickory Boulevard. The exiting lanes are to be signed and striped as a mandatory right turn lane and left turn lane, respectively.

Provide a 12-foot eastbound right turn lane on Old Hickory Boulevard at the entrance roadway. This lane shall be 150 feet in length.

Provide a 12-foot westbound left turn lane on Old Hickory Boulevard at the entrance roadway. This lane shall be 150 feet in length.

All lanes shall be constructed with tapers in accordance with ASHTO standards.

All lots within the PUD shall be limited to single-family development.

Section 4. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO

ORDINANCE NO. BL2003-1394

Mr. President:

I move to amend Ordinance No. BL2003-1394 as follows:

By deleting the phrase “171 single-family lots”, wherein it appears in the caption of the ordinance and in Section 1, and substituting in lieu thereof the phrase “161 single-family lots”.

By amending the Planned Unit Development document by increasing the brick component from a minimum of 30% brick to a minimum of 50% brick.
