ORDINANCE NO. BL2003-1391


An ordinance approving a lease agreement between J. D. Eatherly Properties and The Metropolitan Government of Nashville and Davidson County, acting through the Nashville Career Advancement Center, for certain real property located at 1121 12th Avenue South, Nashville, Tennessee (Proposal No. 2003M-042U-10).

WHEREAS, J. D. Eatherly Properties owns certain real property located at 1121 12th Avenue South, Nashville, Tennessee; and

WHEREAS, the Metropolitan Government has determined that the aforesaid property is needed to provide office space for the Metropolitan Nashville Police Department for continued use as the Police Alert Center; and

WHEREAS, the Director of Public Property Administration is authorized to lease real property, subject to the approval of the Metropolitan Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Lease Agreement between J. D. Eatherly Properties and The Metropolitan Government of Nashville and Davidson County, for rental in an amount not to exceed $28,000.00 for the first three years and $28,840.00 for the fourth and fifth years for a term beginning on February 1, 2003 and ending on January 31, 2008, a copy of which is attached hereto and incorporated herein, is hereby approved.

SECTION 2. The rent shall be paid out of the Metropolitan Nashville Police Department Fund, (BU31130270 West Sector).

SECTION 3. That any amendments to this Lease Agreement shall be approved by resolution of the Metropolitan Council receiving twenty one affirmative votes.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2003-1391 by deleting the phrase “, acting

through the Nashville Career Advancement Center,”, wherein it appears in the caption of

the ordinance, in its entirety.
