ORDINANCE NO. BL2003-1377

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a preliminary Planned Unit Development to property located at 735 Tulip Grove Road, abutting the east margin of Tulip Grove Road, north of Chandler Road, classified R10 and proposed for RM6, (17.41 acres), to permit the development of an 80 unit townhome development, (Proposal No. 2003P-003G-14).


NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By applying a preliminary Planned Unit Development district to property located at 735 Tulip Grove Road, abutting the east margin of Tulip Grove Road, north of Chandler Road, classified R10 and proposed for RM6, (17.41 acres), to permit the development of an 80 unit townhome development, as being Property Parcel No. 2 as designated on Map 76 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described by lines, words and figures on the attached plan, which is attached to and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 76 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, with the submittal of any final PUD plan, construction plans for a southbound left-turn lane on Tulip Grove Road into the project site must be provided to the Metro Planning Department and Public Works Department for review and approval.

Section 4. Be it further enacted, the final PUD plan must include a revision showing the private access drive for the townhouse development aligning with Scotts Creek Parkway.

Section 5. Be it further enacted, the final PUD plan must label and include the required “Dedicated Conservation/Greenway Public Access Trail Easement Area.” Any variance from Section 2-7.5 of the Subdivision Regulations, including the floodway plus a corridor of 75-feet measured from the outside edge of the floodway, shall be approved by Metro Parks.

Section 6. Be it further enacted, pursuant to comments by Metro Water Services Department, final determination of floodway and floodplain lines must be made prior to approval of any final PUD plans. Upon final determination of floodway and floodplain lines, all of the designated floodway and a minimum of two-thirds of the designated floodplain must be maintained in a predevelopment state.

Section 7. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
