An ordinance authorizing the Director of the Metropolitan Department of Water and Sewerage Services to enter into a CAD Limitation of Liability Agreement with the Tennessee Department of Transportation and to allow the Director to enter into CAD Limitation of Liability Agreements with other agencies.

WHEREAS, the Director of the Metropolitan Department of Water and Sewerage Services wishes to enter into a CAD Limitation of Liability Agreement (attached as Exhibit 1) with the Tennessee Department of Transportation; and,

WHEREAS, the Department of Water and Sewerage Services has requests from outside agencies to enter into a CAD Limitation of Liability Agreement with the department; and,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. That the Director of the Metropolitan Department of Water and Sewerage Services is hereby authorized to execute a CAD Disclaimer and Limitation of Liability with the Tennessee Department of Transportation (Exhibit 1).

SECTION 2. That the Director of the Department of Water and Sewerage Services has the authority to accept requests from outside agencies to be able to access Metro Water Services’ Electronic Files and to enter into CAD Disclaimer and limitation of Liability Agreements (Exhibit 2) as needed to conduct the business of the Department.

SECTION 3. Any needed changes to these CAD Disclaimer and limitation of Liability Agreements may be approved by resolution.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
