ORDINANCE NO. BL2003-1351

An ordinance authorizing the Metropolitan Government to participate with Woodbine Community Organization for the construction of Project No. 02-SG-154, 200 L.F. of 6-inch public sewer main at the rear of Parcels 314,315,316, and 317 of Map 119.

WHEREAS, Metro and Woodbine Community Organization desire to improve public sewer service near Timmons Street at Simmons Avenue; and,

WHEREAS, this agreement is deemed to benefit both parties and the general community; and,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. That the Director of Water and Sewerage Services acting on behalf of the Metropolitan Government is hereby authorized to execute a participation agreement, Exhibit 1, with Woodbine Community Organization to improve public sewer services to Timmons Street at Simmons Avenue, Map 119, Parcels 314,315,316, and 317, Project No. 02-SG-154.

SECTION 2. That Woodbine Community Organization agrees to pay the lesser of 50% of the survey, design and construction cost or $5,000.00 prior to the completion of construction, and these funds are to be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. For future maintenance of this line, Woodbine Community Organization agrees to dedicate to Metro a 20-foot wide water and sewer easement along with the proposed sewer main, which lies inside the private property of Woodbine Community Organization.

SECTION 4. Any amendments to this legislation may be processed by resolution.

SECTION 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
