An ordinance approving a facility use agreement by and between The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Social Services Commission and the Salvation Army for housing of a childcare center (Proposal No. 2003M-021U-05).

Whereas, the Metropolitan Social Services Commission is in need of space in order to house its childcare center; and

Whereas, the Metropolitan Social Services Commission has negotiated a facility use agreement of space at 617 Stockell Street, Nashville, TN with the Salvation Army, a copy of which is attached hereto; and

Whereas, the agreement is for a period of five (5) years commencing October 1, 2002 for the cost of the pro-rata portion of utilities, custodial and maintenance costs; and

Whereas, it is deemed to be in the best interest of the Metropolitan Government to approve said agreement.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That this facility use agreement with The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Social Services Commission and the Salvation Army for housing of a childcare center, for a term of five (5) years for the cost of the pro-rata portion of utilities, custodial and maintenance costs, a copy of which is attached hereto, is hereby approved.

Section 2: That any amendments to this agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
