ORDINANCE NO. BL2003-1348

An Ordinance authorizing the Metropolitan Government to participate with Thomas L. Cunningham for the construction of Project No. 01-WG-67, 12-inch water main in Campbell Road from Brick Church Pike to the existing pressure reducing valve near Old Dickerson Road, and execute the necessary documents.


WHEREAS, Thomas L. Cunningham, has expressed a desire to provide public water service to his proposed development, preliminarily referred to as Hidden Acres, as well as existing properties in the area of Old Dickerson Road; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, will need to extend our 12-inch water main in Campbell Road as a result of this project; and

WHEREAS, it is deemed in the best interest of the public to construct said improvements, and Thomas L. Cunningham, has agreed to pay $2,500 for each individual lot, not to exceed $172,500.00, as a contribution in aide; and

WHEREAS, this work is identified in Metro’s Capital Improvement Budget as CIB No. 98-WC0001; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. That the Metropolitan Director of the Department of Water and Sewerage Services, acting for the Metropolitan Government is hereby authorized to execute a participation agreement, Exhibit 1, with Thomas L. Cunningham, to provide public water services to sixty nine (69) lots in the Old Dickerson Road area, preliminarily referred to as Hidden Acres, Metro Project No. 01-WG-67; and

SECTION 2. Metro Project No. 01-WG-67 consists of the construction of approximately 14,000 lineal feet of 12-inch water main in Campbell Raod from Brick Church Pike to approximately 1200 foot beyond the existing pressure reducing valve near Old Dickerson Road, complete with all appurtenances.

SECTION 3. That the $2,500 per lot to be received as a contribution-in-aid of construction will be deposited in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 4. Any amendments to this legislation may be processed by Resolution.

SECTION 5. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
