An ordinance approving a corrected deed conveying certain real property interests to the Nashville & Eastern Railroad Authority in connection with construction of the Gateway Boulevard project (Proposal No. 2003M-020U-09).

Whereas, pursuant to Substitute Ordinance No. BL2002-1132, the Metropolitan Council approved the execution of a deed (the “Deed”) conveying fee simple interest, subject to certain retained easements, in a parcel of real property (“Parcel 1”) and a permanent easement on another parcel of real property (“Parcel 2”) to the Nashville & Eastern Railroad Authority; and

Whereas, the Deed inaccurately stated the lengths of certain boundary segments and the total square footage comprising Parcel 1; and

Whereas, the Nashville & Eastern Railroad Authority and the Metropolitan Government desire to correct the inaccuracies in the Deed prior to recording; and

Whereas, the deed (the “Corrected Deed”) attached to this ordinance as Exhibit A and incorporated herein by reference accurately states the legal descriptions of the affected parcels of property; and

Whereas, conveyance of the referenced interests in Parcel 1 and Parcel 2 is necessary for the construction of the Gateway Boulevard project; and

Whereas, it is in the best interests of the Metropolitan Government to nullify the Deed and approve the execution and recording of the Corrected Deed.

Now therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the Director of Public Property is hereby authorized to execute the deed attached as Exhibit A to the Nashville & Eastern Railroad Authority.

Section 2: That the deed approved by Ordinance No. BL2002-1132 is declared a nullity.

Section 3: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
