An Ordinance authorizing the Metropolitan Government to participate with Pulte Home Tennessee Limited Partnership, to provide public sewer service in Chestnut Springs, Phase 2, Project No. 01-SL-129, in Williamson County and authorizing future participation agreements to be approved by resolution.

WHEREAS, Pulte Home Tennessee Limited Partnership has expressed a desire to provide public sewer service in Chestnut Springs, Phase 2, in Williamson County, Tennessee; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has funded the Owl Creek Trunk Sewer, Project No. 97-SG-84 anticipating participation from developers; and

WHEREAS, public sewer service is deemed to benefit both parties to this agreement the general community; and

WHEREAS, Pulte Home Tennessee Limited Partnership agrees to pay an amount not to exceed $2,000.00 per connection, an amount not to exceed $126,000.00 towards the cost of the Owl Creek Trunk Sewer Project; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of the Metropolitan Department of Water and Sewerage Services is hereby authorized to execute a participation agreement, Exhibit 1, with Pulte Home Tennessee limited Partnership to provide public sewer services in Williamson County, Tennessee, to the Chestnut Springs, Phase 2, Project No. 01-SL-129.

SECTION 2. That Pulte Home Tennessee Limited Partnership agrees to pay an amount not to exceed $126,000.00, for connections to the Owl Creek Trunk Sewer.

SECTION 3. That the $126,000.00 is to be received as a contribution-in-aid of construction and deposited in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 4. That future participation agreements may be approved by resolution.

SECTION 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
