ORDINANCE NO. BL2002-1291

An ordinance authorizing the Metropolitan Government to participate with James Edward Scott Lewis, for the relocation of the combined sewer at 415 Chestnut Street, Project No. 99-SG-153, and execute the necessary documents.


WHEREAS, James Edward Scott Lewis, has expressed a desire to relocate the combined sewer lying underneath the building at 415 Chestnut Street near Fourth Avenue, Metro Project No. 99-SG-153; and


WHEREAS, it is deemed in the best interest of the public to construct said improvements, and James Edward Scott Lewis, has agreed to pay $60,975 in five equal payments of $12,195 each year on or before January 1st, with the first payment due January 1, 2003; and


WHEREAS, this work is identified in Metro’s Capital Improvement Budget as CIB No. 99SG0001; and


NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.


SECTION 1. That the Metropolitan Mayor, acting for the Metropolitan Government is hereby authorized to execute a participation agreement, Exhibit 1, with James Edward Scott Lewis, to relocate a stone, brick and metal combination sewer currently lying underneath the building at 415 Chestnut Street near 4th Avenue North. The relocation will require approximately 456 L.F. of 48-inch reinforced concrete public sewer, complete with all appurtenances, Metro Project No. 99-SG-153.

SECTION 2. That the $60,975 received as a contribution-in-aid of construction will be deposited in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. Any further amendments to this Legislation may be processed by resolution.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2002-1291 by deleting Section 3 in its entirety

and substituting in lieu thereof the following new Section 3:

“That any amendments to the participation agreement authorized herein shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.”
