ORDINANCE NO. BL2002-1288

An ordinance abandoning a 4’ portion of a Public Utility Easement located on Map 117-15, Parcel 196.00 of Project No. 02-DG-156, 1728 Glen Echo Road, (Proposal No. 2002M-116U-10).

WHEREAS, Gregory S. Perrone, Trustee is the owner of real property encumbered by a Public Utility Drainage Easement; and,

WHEREAS, portions of the existing Public Utility Drainage Easement are no longer being used by the Department of Water and Sewerage Services, nor any other Public Utility Entity more particularly described on the map for Project No. 02-DG-156, 1728 Glen Echo Road, Public Utility Drainage Easement, on record in the office of the Director of Water and Sewerage Services, said map is made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services now has no need for the portion of the said easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved this abandonment on 11/21/2002, Proposal No. 2002-M-116U-10 of said Public Utility Drainage Easement; and

WHEREAS, The Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Public Utility Drainage Easement shown on Map 117-15, Parcel 196.00, and shown on Project No. 02-DG-156, 1728 Glen Echo Road, Public Utility Drainage Easement abandonment, is declared abandoned, and the Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

SECTION 3: Any further amendments to this Legislation may be processed by resolution.

Mr. President:

I move to amend Ordinance No. BL2002-1288 by deleting the phrase “1728 Glen Echo Road”, wherein it appears in the caption of the ordinance, the second recital clause, and in Section 1 of the ordinance, and substituting in lieu thereof the phrase “1726 Glen Echo Road”.
