WHEREAS, the owner of the Tax Map 148, Parcel 79 has agreed to donate the fee simple interest in the portion of the property described in the document attached as Exhibit A to this ordinance to the Metropolitan Government, for the use and benefit of the Greenway Commission; and

WHEREAS, the property will be used to construct, operate and maintain a portion of the greenway system; and

WHEREAS, the citizens of Nashville and Davidson County will benefit by accepting the donated land.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Director of Public Property is hereby authorized to accept and record title from the owner of the said property to that portion of Tax Map 148, Parcel 79 generally described as

Bounded on the North by the CSX Transportation Railroad, on the South by the Cummings Court, LLC property, bounded on the East by the remainder of the First Industrial, L.P. parcel, bounded on the West by William R. Underwood property, Billy R. Dean property, U-Wash Auto Systems, Inc. property, Antioch Auto Parts, Inc. property, Kathryn Bubis property and Rosalind S. Seay property, containing 4.47 acres, more or less, the boundaries being approximately 89 feet on the North, 1117 feet on the East, 255 feet on the South, and 1159 feet on the West,

And being more particularly described in the attachment to Exhibit A.

SECTION 2. The costs associated with this transfer will be paid out of Fund No. 4100, BU 40404190.

SECTION 3. This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
