WHEREAS, an existing 36” sewer line and the accompanying sewer easement are no longer being used by the Department of Water and Sewerage Services. Upon completion and acceptance of proposed relocation to abandon existing sewer line and easement more particularly described on the plans for Project No. 02-SL-48, The Row at 31st Avenue, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County on October 15, 2002, approved this mandatory referral number 2202M-102U-10 for abandonment of said easement; and,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer line and the sewer easement shown on Map 104-02, Parcel 244 & 247, Project No. 02-SL-48, The Row at 31st Ave., copy attached, are declared abandoned, upon installation and acceptance by Metro Water Services of proposed relocation. Metropolitan Government agrees to abandon the existing sewer line and the Director of Water and Sewer Services and Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: Any further amendments to this Legislation may be processed by resolution.

SECTION 3: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2002-1249

Mr. President:

I move to amend Ordinance No. BL2002-1249 by:

1. Deleting Section 1 in its entirety and substituting in lieu thereof the following new Section 1:

“That the 36” sewer line and the 20’ sewer easement shown on Map 104-02, Parcel 244 & 247, Project No. 02-SL-48, The Row at 31st Ave., a copy of which is attached, are declared abandoned.”

2. Deleting Section 2 in its entirety and substituting in lieu thereof the following new Section 2:

“The sewer line and easement abandonment in Section 1 shall not become effective until the proposed sewer line relocation shown on the attached map is installed and is accepted by Metro Water and Sewer Services. After such installation and acceptance the Director of Water and Sewer Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such abandonment.”
