ORDINANCE NO. BL2002-1245

An ordinance approving the disposition of a certain parcel of property by the Director of Public Property held by The Metropolitan Government of Nashville and Davidson County (1002 Saunders Avenue, Madison, TN) (Proposal No. 2002M-113G-04).


Whereas, pursuant to an order issued by the Chancery Court of Davidson County (attached as Exhibit A and included herein) forfeiting a certain parcel of property at 1002 Saunders Avenue, Madison, Tennessee, being Map 051-03, Parcel 193, to The Metropolitan Government of Nashville and Davidson County via the Metropolitan Nashville Police Department; and

Whereas, pursuant to an order issued by the Chancery Court of Davidson County (attached as Exhibit B and included herein) that the certain parcel of property be sold at public auction in accordance with T.C.A. § 39-11-701 et seq.; and

Whereas, pursuant to an order issued by the Chancery Court of Davidson County (Exhibit B), all proceeds from the sale of the certain parcel of property are to be distributed in accordance with T.C.A. § 39-11-713 and Metropolitan Ordinance No. O99-1805; and

Whereas, the Public Property Administration shall establish a minimum selling price based on an independent appraisal; and

Whereas, the Director of Public Property is authorized to sell real property at auction subject to the approval of the Metropolitan Council and the Mayor.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: Having been ordered by the Chancery Court, the Metropolitan County Council shall sell the following parcel of land at public auction:

Section 2. The Director of Public Property is hereby authorized and directed to sell said property listed above, for a minimum amount according to an independent appraisal, in accordance with the Standard Rules and Regulations for the disposition of surplus real property for the best and highest price.

Section 3. The proceeds from the sale of said parcel of property shall be distributed to the Police State Gambling Forfeiture Fund.

Section 4. This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
