ORDINANCE NO. BL2002-1240

An ordinance reducing a triangularly shaped Public Utility Drainage and Storm Pipe Easement to a 10-foot wide Public Utility Drainage and Storm Pipe Easement located on Map 97-08, Parcel 009.00 of Project No. 02-SW-120, 4009 Lake Parkway, (Proposal No. 2001M-089G-14).

WHEREAS, Earnest J. Phipps is the owner of real property encumbered by a Public Utility Drainage and Storm Pipe Easement; and,

WHEREAS, portions of the existing Public Utility Drainage and Storm Pipe Easement located at 4009 Lake Parkway and more particularly described on the map for Project No. 02-SW-120, on record in the office of the Director of the Metropolitan Department of Water and Sewerage Services (the “Department”), is no longer required for use by the Department; and

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has approved the reduction of said Public Utility Drainage and Storm Pipe Easement on September 12, 2002, Proposal No. 2002M-089G-14.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the existing Public Utility Drainage and Storm Pipe Easement shown on Section One, Lot #3 of the attached subdivision plat for Lake Park, is declared reduced to a 10-foot wide Public Utility Drainage and Storm Pipe Easement adjacent to the Southeasterly property line of the aforesaid Lot # 3 as indicated, and the Director of Water and Sewerage Services and the Director of Public Property Administration are hereby authorized to execute the appropriate instruments to carry out such reduction.

SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

SECTION 3: Any further amendments to this Legislation may be processed by resolution.
