ORDINANCE NO. BL2002-1239

An ordinance approving the donation of certain surplus cellular telephones held by The Metropolitan Government of Nashville and Davidson County to various not for profit domestic violence organizations.


Whereas, The Metropolitan Government of Nashville and Davidson County owns numerous cellular telephones that have been deemed surplus; and

Whereas, these cellular telephones were obtained at no cost to Metro, cannot be returned to the suppliers and many are considered obsolete by industry standards; and

Whereas, The Metropolitan Government of Nashville and Davidson County has determined that these cellular telephones are no longer needed for general government purposes; and

Whereas, the Surplus Property Division of the Department of Finance has been contacted by numerous domestic violence organizations who wish to use the cellular telephones for programming of emergency numbers and distribution to those persons seeking assistance and refuge from domestic violence; and

Whereas, it is deemed to be in the best interest of the Metropolitan Government to authorize the donation of the surplus cellular telephones to not for profit organizations for distribution to persons seeking assistance and refuge from domestic violence.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That The Metropolitan Government of Nashville and Davidson County is hereby authorized to donate surplused cellular telephones that were obtained at no cost to Metro or which cannot be sold at public auction, to not for profit domestic violence agencies for programming of emergency numbers and for distribution to persons seeking assistance and refuge from domestic violence.

Section 2: That not for profit domestic violence agencies in Davidson County shall be given first priority for distribution of the surplus of the cellular telephones.

Section 3: That any amendments to this ordinance shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
