ORDINANCE NO. BL2002-1219

An ordinance to abandon a 57-foot Public Utility Easement and a 20-foot Sewer Easement located on Map 93-06-4, Parcel 062.00 of Project No. 02-SW-140, Symphony Hall, (Proposal No. 2002M-091U-09).

WHEREAS, The Metropolitan Government of Nashville and Davidson County is the owner of real property encumbered by a Public Utility and Sewer Easement; and,

WHEREAS, portions of the existing Public Utility and Sewer Easement are no longer being used by the Metropolitan Government of Nashville and Davidson County Department of Water and Sewerage Services, nor any other Public Utility Entity more particularly described on the map for Project No. 02-SW-140, Symphony Hall, Public Utility and Sewer Easement, on record in the office of the Director of Water and Sewerage Services, said map is made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services now has no need for the portion of the said easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said Public Utility and Sewer Easement on August 29, 2002 by proposal number 2002M-091U-09.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Public Utility and Sewer Easement shown on Map 93-06-4, Parcel 062.00, and shown on Project No. 02-SW-140, Symphony Hall, Public Utility and Sewer Easement abandonment, is declared abandoned, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein.

SECTION 2: Any further amendments to this Legislation may be processed by resolution.

SECTION 3: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
