ORDINANCE NO. BL2002-1217

An ordinance abandoning the Water Pumping Station on Map 131-13, Parcel 35, Skymont Water Pumping Station of Project No. 02-WG-92. (Proposal No. 2002M-086G-10), District 33.

WHEREAS, Edward L. Hiland, Et ux, is the owner of real property encumbered by a water pumping station in a utility easement on his property and,

WHEREAS, the Water Pumping Station is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 02-WG-92, Skymont Water Pumping Station Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said Water Pumping Station and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has approved the abandonment of said Water Pumping Station, Proposal No. 2002M-086G-10.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Water Pumping Station shown on Map 131-13, Parcel 35, and shown on Project No. 02-WG-92, Skymont Water Pumping Station Abandonment, copy attached, are declared abandoned. Metropolitan Government agrees to abandon the Water Pumping Station and are hereby authorized to execute the appropriaate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

SECTION 3. Any further amendments to this legislation may be processed by resolution.
