ORDINANCE NO. BL2002-1216

An ordinance authorizing the Metropolitan Government to participate with Laura Wilhite, to provide public sewer service in Stonebrook Subdivision, Section 13-C in Williamson County, Project No. 98-SL-088A.

WHEREAS, Laura Wilhite has expressed a desire to for public sewer service in Stonebrook Subdivision, Section 13-C in Williamson County, Tennessee; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has funded the Upper Mill Creek Trunk Sewer, Project No. 98-SG-13 anticipating participation from developers and homeowners; and

WHEREAS, it is deemed to benefit both parties and the general community, and Laura Wilhite agrees to pay an amount not to exceed $2,000.00 to participate in the construction costs of downstream sewerage system extension and $2,500.00 her proportionate share of upgrade costs to the Stonebrook Subdivision Main Sewer Pumping Station; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of the Metropolitan Department of Water and Sewerage Services is hereby authorized to execute participation agreements, Exhibit 1 and 2, with Laura Wilhite to provide public sewer services in Williamson County, Tennessee, known as Stonebrook Subdivision, Section 13-C, Project No. 98-SL-088A.

SECTION 2. That Laura Wilhite agrees to pay an amount not to exceed $2,000.00, for a single-family home connections for lot 1322 (866 Dortch Lane) and $2,500.00 her proportionate share of upgrade cost to the Stonebrook Subdivision Main Sewer Pumping Station.

SECTION 3. That the $2,000.00 and $2,500.00 are to be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.


SECTION 4. That future authorizing to execute participation agreements with developers or property owners in Williamson and Wilson Counties may be approved by resolution.

SECTION 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2002-1216

Mr. President:

I move to amend Ordinance No. BL2002-1216 by deleting Section 4 in its entirety

and renumbering the subsequent section accordingly.
