ORDINANCE NO. BL2002-1214

An ordinance authorizing the conveyance of certain interests in three parcels of real property to the State of Tennessee in conjunction with the construction of Project Nos. 19045-2237-94 and 19076-2242-14 (Parcels 1 & 2, Proposal No. 2002M-100G-03)(Parcel 3, Proposal No. 2002M-101U-14).


WHEREAS, the Metropolitan Government owns certain real property comprising Whites Creek Park and identified as Tax Map 40, Parcel 142, an easement upon a portion of which (“Parcel 1”), as shown in Exhibit A, is required by the State of Tennessee for use in connection with construction of Project No. 19045-2237-94; and

WHEREAS, the Metropolitan Government owns certain real property comprising the Whites Creek High School grounds and identified as Tax Map 40, Parcel 21, the fee interest in a portion of which (“Parcel 2”), as shown in Exhibit B, is required by the State of Tennessee for use in connection with construction of Project No.19045-2237-94; and

WHEREAS, the State of Tennessee has offered to purchase the referenced interests in Parcel 1 and Parcel 2 for a total of $400; and

WHEREAS, the Metropolitan Government owns certain real property comprising Two Rivers Park and identified as Tax Map 84, Parcel 21, an easement upon a portion of which (“Parcel 3”), as shown in Exhibit C, is required by the State of Tennessee for use in connection with construction of Project No. 19076-2242-14; and

WHEREAS, the State of Tennessee has offered to purchase the referenced interest in Parcel 3 for a total of $1,800; and

WHEREAS, the Director of Public Property Administration has determined that the offers (the “Offers”) presented by the State of Tennessee to acquire the referenced interests in Parcel 1, Parcel 2 and Parcel 3 to be fair and reasonable; and

WHEREAS, the Board of Parks and Recreation and the Board of Education have approved the conveyance of the referenced interests in Parcel 1, Parcel 2 and Parcel 3 to the State of Tennessee; and

WHEREAS, it is in the best interest of the Metropolitan Government to accept the Offers.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Director of Public Property Administration is hereby authorized and directed to convey to the State of Tennessee the easements in Parcel 1 and Parcel 3 and the fee interest in Parcel 2 at the prices indicated herein and to execute the documents necessary to effect the terms of this Paragraph.

Section 2. The proceeds from the conveyance of the easements on Parcel 1 and Parcel 3 shall be credited to the General Fund of the Metropolitan Government and proceeds from the conveyance of the fee interest in Parcel 2 shall be credited to the General Purpose School Fund.

Section 3. This ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
