ORDINANCE NO. BL2002-1201
An ordinance abandoning and relocating a portion of a sewer line and easement upon completion of installation and acceptance of proposed relocation. Metropolitan Government agrees to abandon existing sewer line and easement on Map 092-11, Alley Nos. 909 and 927, of Project No. 02-SL-91, HCA Combination Sewer and Easement Abandonment (Proposal No. 2002M-068U-10). District 19
WHEREAS, said abutting property owners of real property encumbered by a sewer line and sewer easement; and,
WHEREAS, an 8” existing sewer line and the accompanying sewer easement are no longer being used by the Department of Water and Sewerage Services. Upon completion of installation and acceptance of proposed relocation to abandon existing sewer line and easement more particularly described on the plans for Project No. 02-SL-91, HCA Combination Sewer and Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,
WHEREAS, the Department of Water and Sewerage Services now has no need for the said easement; upon completion of installation and acceptance of proposed relocation of the sewer line and easement; and,
WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County on July 11, 2002, approved this mandatory referral 2002M-068U-10 for abandonment of said easement; and,
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the sewer line and the sewer easement shown on Map 092-11, Alley Nos. 909 and 927, and shown on Project No. 02-SL-91, copy attached, are declared abandoned, upon installation and acceptance by Metro Water Services of proposed relocation. Metropolitan Government agrees to abandon the existing sewer line and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonment.
SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
