WHEREAS, The Metropolitan Government of Nashville and Davidson County, has agreed to accept an easement from the Corps of Engineers, attached hereto as Exhibit A and made a part hereof; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County agrees to construct, operate and maintain a culvert, ditch and 18” pipeline for the benefit of the general public; and

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY

SECTION 1: That the Metropolitan Director of Public Property is approved to execute an easement with Corps of Engineers, attached hereto as Exhibit A and made a part hereof.

SECTION 2: That the Metropolitan Directors of Water and Sewerage Services and Public Works are hereby authorized to accept the easement for construction, operation and maintenance of a culvert, ditch and 18” pipeline.

SECTION 3: That this ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
