WHEREAS, the Metropolitan Government of Nashville and Davidson County, has agreed to accept an easement from the Corps of Engineers, attached hereto as Exhibit A and made a part hereof; and

WHEREAS, the Metropolitan Government of Nashville and Davidson County agrees to construction, operation and maintenance of a 20” drainage easement and replacement of an 18” outfall pipeline for the benefit of the general public.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY

SECTION 1: That the Metropolitan Director of Public Property is approved to execute an easement with the Corps of Engineers, attached hereto as Exhibit A and made a part hereof.

SECTION 2: That the Metropolitan Directors of Water and Sewerage Services and Public Works are hereby authorized to accept the easement for construction, operation and maintenance of a 20” drainage easement and replacement of an 18” outfall pipeline.

SECTION 3: That this ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2002-1197

Mr. President:

I move to amend Ordinance No. BL2002-1197 by deleting the phrase “maintenance of a 20” drainage easement”, wherein it appears in the second recital clause and in Section 2, and substituting in lieu thereof the phrase “maintenance of a 20 foot drainage easement”.
