ORDINANCE NO. BL2002-1193

An ordinance approving an agreement between the Metropolitan Government, JDN Realty Corporation and Wal-Mart Real Estate Business Trust relating to the establishment of access, drainage and maintenance rights to a certain parcel of property in Davidson County (Proposal No. 2002M-092G-06).

Whereas, pursuant to Ordinance No. BL2001-691, JDN Realty Corporation donated a parcel of property (the “Property”) in Davidson County to the Metropolitan Government for use as part of the park and greenway system; and

Whereas, pursuant to the terms of the Access and Drainage Easement Agreement (the “Agreement”) attached to this ordinance as Exhibit A, JDN Realty Corporation (“JDNR”) and Wal-Mart Real Estate Business Trust (“Wal-Mart”) propose to grant the Metropolitan Government a permanent access easement to the Property; and

Whereas, pursuant to the terms of the Agreement, the Metropolitan Government proposes to grant to JDNR and Wal-Mart an access and drainage easement to permit full use of tracts adjacent to the Property; and

Whereas, approval of the Agreement will benefit the citizens of Davidson County by enhancing the quality and availability of recreational opportunities in Davidson County.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the Metropolitan Director of Public Property is hereby authorized to execute the attached Agreement between The Metropolitan Government of Nashville and Davidson County, JDN Realty Corporation and Wal-Mart Real Estate Business Trust.

Section 2: That any amendments, renewals or extension of the terms of the Agreement must be approved by resolution of the Metropolitan Council.

Section 3: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
