ORDINANCE NO. BL2002-1179

An ordinance abandoning a portion of a water line, drainage, and public utility easements on Map 64-15, Parcels 1, 5, 10, 25-29 of Project No. 02-SL-68, Hermitage Wal-Mart, abandonment and relocation of various public utility and drainage easements and water and sewer line easements Proposal No. 2002M-053G-14). Council District 11.

WHEREAS, MRW Retail Joint Venture, is the owner of real property encumbered by drainage, water and sewer line easements; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easement; and,

WHEREAS, MRW Retail Joint Venture, has need for the use of the drainage, water and sewer lines as private service lines; and,

WHEREAS, all parties are agreeable to the abandonment and relocation of the public drainage, water and sewer line easements of Project No. 02-SL-68, Hermitage Wal-Mart property and have approved the conversion of the public drainage, water and sewer lines to private service lines; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment and relocation of said easements and conversion to private service lines on Jun 27, 2002, 2002M-053G-14.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the drainage, water and sewer line easements shown on Map 64-15, Parcels 1, 5 and Map 64-15, Parcels 10, 25-29, are declared abandoned and relocated for public use and converted to private service lines, and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonments and relocation conversion.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2002-1179


Mr. President:

I move to amend Ordinance No. BL2002-1179 by deleting the phrase “the below signed”, wherein it appears in Section 1, and substituting in lieu thereof the phrase “the Director of Water and Sewerage Services and the Director of Public Property Administration”.
