WHEREAS, CVS Pharmacy is the owner of real property encumbered by a sewer drainage easement; and,

WHEREAS, the existing sewer drainage easement are no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 02-SG-92 CVS Pharmacy, Sewer Drainage and Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services now has no need for the said easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easement on July 2, 2002, 2002M-074U-05.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer drainage easement shown on Map 72-14, Parcel 031.00, and shown on Project No. 02-SG-92 CVS Pharmacy, Sewer Drainage and Easement Abandonment, is declared abandoned, and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2002-1178

Mr. President:

I move to amend Ordinance No. BL2002-1178 by deleting the phrase “the below signed”, wherein it appears in Section 1, and substituting in lieu thereof the phrase “the Director of Water and Sewerage Services and the Director of Public Property Administration”.
