ORDINANCE NO. BL2002-1177

An ordinance approving an agreement between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County for reimbursement of funds expended for litter pickup.

Whereas, Tennessee Code Annotated, Section 41-2-123, provides that the Commissioner of Transportation is authorized to make grants to the several counties of the State for the purpose of funding programs for the collection of litter and trash along the county, state and interstate roads and highways within the respective counties; and

Whereas, the State of Tennessee, Department of Transportation, has awarded Grant No. CHB1066 in an amount not to exceed two hundred eight thousand eight hundred seventy three dollars ($208,873) to the Metropolitan Government of Nashville and Davidson County, for reimbursement of funds expended for litter and trash pickup within Davidson County; and

Whereas, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that this grant be accepted.

Now, therefore, be it enacted by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the attached contract between the State of Tennessee by and for its Department of Transportation and the Metropolitan Government of Nashville and Davidson County, pursuant to Tennessee Code Annotated § 41-2-123, for litter and trash pickup along certain routes within Davidson County in an amount not to exceed two hundred eight thousand eight hundred seventy three dollars ($208,873) is hereby approved, and the Mayor is authorized to execute same.

Section 2. That any amendments to this grant shall be approved by resolution of the Metropolitan Council receiving at least twenty-one affirmative votes.

Section 3: That this Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
