ORDINANCE NO. BL2002-1146
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 District to CL District property at LaVergne-Couchville Pike (unnumbered), at the intersection of LaVergne-Couchville Pike and Murfreesboro Pike, (10.80 acres), all of which is more particularly described herein (Proposal No. 2002Z-066G-13).
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT
OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:
By changing from R10 District
to CL District property at LaVergne-Couchville Pike (unnumbered), at the intersection
of LaVergne-Couchville Pike and Murfreesboro Pike, (10.80 acres), being more
particularly described as being Property Parcel No. 166 as designated on Map
175 of the Official Property Identification Maps of The Metropolitan Government
of Nashville and Davidson County, all of which is more particularly described
by lines, words and figures on the attached plan, which is attached to and made
a part of this ordinance as though copied herein.
Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized
and directed, upon the enactment and approval of this ordinance, to cause the
change to be made on Sheet No. 175 of said Official Zoning Map for Metropolitan
Nashville and Davidson County, as set out in Section 1 of this ordinance, and
to make notation thereon of reference to the date of passage and approval of
this amendatory ordinance.
Section 3. Be it further enacted, that this ordinance take effect immediately
after its passage and such change be published in a newspaper of general circulation,
the welfare of The Metropolitan Government of Nashville and Davidson County
requiring it.
Section 4. Be it further enacted, that the rezoning of the subject property to CL is subject to the following roadway and traffic improvements:
Construct a new left turn
lane into the site with 75 feet of storage at the LaVergne-Couchville Pike site
access.
Widen LaVergne-Couchville Pike to a 3-lane section from Murfreesboro Road to
the site access. This will allow LaVergne-Couchville Pike to be striped with
separate left and right turn lanes at the existing signal on Murfreesboro Road.
At the northern Murfreesboro Road site access, site access should be constructed
with separate left and right turn lanes exiting onto Murfreesboro Road. Existing
shared center turn lane on Murfreesboro Road should be re-striped at the site
access to a left turn lane.
Existing pavement on Hickory Woods Drive should be striped to include separate
left and right turn lanes at Murfreesboro Road.
At the Hickory Woods Drive site access, site access should be constructed with
separate left and right turn lanes exiting onto Hickory Woods Drive.
At the southern Murfreesboro Road site access, the median on Murfreesboro Road
should be removed and the center turn lane extended from the northern Murfreesboro
Road site access. Then the site access should be constructed with separate left
and right turn lanes exiting onto Murfreesboro Road.
A traffic signal needs to be installed by the developer at the intersection
of Murfreesboro Road and Hickory Woods Drive.
