ORDINANCE NO. BL2002-1136

An ordinance authorizing the Metropolitan Mayor to make an application and execute the necessary documents to secure wastewater grants and loans from the State of Tennessee to fund the wastewater projects listed herein.


WHEREAS, the U. S. Environmental Protection Agency has, under Title II of the Clean Water Act, created a grant program to the State of Tennessee to assist the local wastewater agency in the construction of water pollution abatement projects; and

WHEREAS, the State of Tennessee has created a state loan and grant program to assist the local governments to fund all or part share of the project costs.

NOW THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is authorized to make application for and execute all necessary documents applying for and securing a grant and/or loan to fund the following eligible pollution abatement projects:

SECTION 2: That in the future projects can be added to this list by resolution approved by the Metropolitan Council.

SECTION 3: That the Metropolitan Mayor is hereby authorized to execute the necessary contracts with the State of Tennessee to accept state loans and/or grants to fund the projects identified in Section 1.

SECTION 4: That the Metropolitan Mayor is hereby authorized to make all applications and to execute all necessary contracts with the State of Tennessee wastewater treatment grant and loan program, as contained in Tennessee Code Annotated 68-221-801 et seq.

SECTION 5: That the Department of Water and Sewerage Services is hereby authorized and directed to take all necessary steps required to enable The Metropolitan Government to participate in state and federal funds, and it is the intention of the Council that this Ordinance be literally construed to effectuate this intent.

SECTION 6: That this Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1

To

Ordinance No. BL2002-1136

Mr. President:

I move to amend Ordinance No. BL2002-1136 as follows:

By amending Section 2 by adding the following provisions:

“Future application for grants and loans under the provisions of T.C.A. § 68-221-801 et seq. made by authorized by resolution adopted by the Council with twenty-one (21) affirmative votes and may be submitted on an annual basis.”
