ORDINANCE NO. BL2002-1135

An Ordinance repealing Section 10.20.287 of the Metropolitan Code which provided for a waste generation fee of six dollars per ton of solid waste generated or collected and disposed of out of Davidson County.


WHEREAS, in 1998 the Metropolitan County Council adopted Ordinance No. 98-1109, as amended, which provided for a waste generation fee to provide funds for waste disposal costs of Metropolitan Government to be collected from solid waste collectors and haulers who dispose of solid waste outside of the area of Metropolitan Government and not at the Nashville Thermal Transfer Corporation (NTTC) facility owned by Metropolitan Government in order to avoid payment of tip fees to Metropolitan Government; and

WHEREAS, as the NTTC no longer uses solid waste as a fuel source for the purposes of producing energy for production of steamed heat and chilled water, and Metropolitan Government has decided to have all solid waste disposed of outside of the area of Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 10.20.287 of the Metropolitan Code shall be and the same is hereby repealed in its entirety.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
