ORDINANCE NO. BL2002-1131

An ordinance authorizing the Director of the Metropolitan Board of Parks and Recreation to enter into a lease agreement with the State of Tennessee for certain property located at the Ellington Agriculture Center on Edmondson Pike for use as a public park (2002M-075U-12).

Whereas, the Metropolitan Charter authorizes the Metropolitan Government to lease property; and

Whereas, pursuant to the agreement (the “Agreement”) attached as Exhibit A and incorporated into this bill by reference, the State of Tennessee proposes to lease to the Metropolitan Government, acting by and through the Metropolitan Board of Parks and Recreation, a parcel of property on Edmondson Pike (the “Property”) for public recreational activities; and

Whereas, approval of the Agreement will help to enhance the recreational opportunities available for Nashville’s citizens.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Agreement (Exhibit A) between the State of Tennessee and the Metropolitan Government, acting through Metropolitan Board of Parks and Recreation, is hereby approved, and the Director of the Metropolitan Board of Parks and Recreation is authorized to execute it.

Section 2. Any amendment to the Agreement must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
