ORDINANCE NO. BL2002-1125

An ordinance abandoning the sewer line and easement on Map 72-13, Parcels 240, 241, 242, and 243, of Project No. 02-SL-055, Nashville Auto Diesel College Sewer Lines and Easement Abandonment when said parcels are consolidated into one (1) tract. (Proposal No. 2002M-041U-05 ) District 07.

WHEREAS, Nashville Auto Diesel College is the owner of real property encumbered by sewer lines and sewer easements; and,

WHEREAS, the sewer line and easement to be abandoned serves no other properties; and,

WHEREAS, the sewer line and sewer easement are no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 02-SL-055, Nashville Auto Diesel College Sewer Lines and Easement Abandonment when said parcels are consolidated into one (1) tract, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easement when said parcels are consoldidated into one (1) tract; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer line and the sewer easement shown on Map 72-13, Parcels 240, 241, 242, and 243 on Project No. 02-SL-055, Nashville Auto Diesel College Sewer Lines and Easement Abandonment, are declared abandoned when consolidated into one (1) tract, and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: Any further amendments to this legislation may be processed by resolution.


SECTION 3: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
