ORDINANCE NO. BL2002-1122

An ordinance amending Section 10.32.160 of the Metropolitan Code of Laws to allow the chief medical director to order the person in ownership or control of any property or facility storing tires to eliminate the collection of water in the tires or take other adequate measures to prevent the breeding of insects.


WHEREAS, Section 10.32.160 currently allows the chief medical director to order the person in control of property where stagnant water collects to employ corrective measures to alleviate the stagnant water to prevent the breeding or harborage of insects and other pests; and

WHEREAS, standing water in tires stored on premises located within the area of the Metropolitan Government poses similar breeding grounds for insects; and

WHEREAS, it is in the best interest of the residents of the Metropolitan Government that tire storage be regulated to prevent the breeding and harborage of insects.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 10.32.160 of the Metropolitan Code of Laws is hereby amended by adding the following subsection:

"b. The chief medical director may order the person in ownership or control of any property or facility storing tires where stagnant water may collect to eliminate the collection of water in the tires or employ other adequate measures to prevent the breeding or harborage of insects and other pests."

Section 2. This ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2002-1122

Mr. President:

I move to amend Ordinance No. BL2002-1122 as follows:

By deleting the phrase “or take other adequate measures to prevent the breeding of insects”, wherein it appears in the caption, and substituting in lieu thereof the phrase “and take other adequate measures to prevent the breeding or harborage of insects, rodents and other pests”.

By deleting the phrase “or employ other adequate measures to prevent the breeding or harborage of insects and other pests”, wherein it appears in Section 1, and substituting in lieu thereof the phrase “and employ other adequate measures to prevent the breeding or harborage of insects, rodents and other pests”.
