ORDINANCE NO. BL2002-1121

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County to enter into an agreement with CPS Land, LLC, and CSX Transportation, Inc. (Proposal No. 2002M-057G-06).

WHEREAS, CPS Land, LLC (CPS), proposes to construct an overhead bridge over tracks belonging to CSX Transportation, Inc. (CSX), in support of the Riverwalk Community at Railroad Milepost 00N-16.83; OP# TN0091, in Bellevue, Davidson County, Tennessee; and

WHEREAS, CSX is willing to grant CPS certain rights and privileges over CSX property for the purpose of constructing said bridge; and

WHEREAS, CSX and CPS desire to dedicate and convey to the Metropolitan Government of Nashville and Davidson County (the Metropolitan Government) both the bridge and sufficient accompanying right-of-way and improvements to facilitate its use for the purpose for which it is intended; and

WHEREAS, the Metropolitan Government is willing to accept said bridge and accompanying right-of-way and improvements subject to the conditions set forth in the agreement hereto attached; and

WHEREAS, it is in the best interests of the Metropolitan Government to enter into said agreement,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The attached agreement with CPS Land, LLC, and CSX Transportation, Inc., is approved; and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. This ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1

Ordinance No. BL2002-1121

Mr. President:

I move to amend Ordinance No. BL2002-1121 as follows:

By amending Section 1 by adding the following provisions:

“The acceptance by Metropolitan Government of the proposed bridge shall be accomplished only by adoption of an ordinance by the Metropolitan Council, any provision in the attached agreement to the contrary notwithstanding.”
