ORDINANCE NO. BL2002-1120
An ordinance authorizing the State of Tennessee to construct, install, and maintain certain improvements within the public right-of-way at the Tennessee Performing Arts Center (2002M-032U-09).
WHEREAS, The State of Tennessee ("the State") plans to construct, install and maintain a sign marquee above the sidewalk within the public right-of-way on Deadrick Street and Sixth Avenue North and an elevator tower on the sidewalk along Deadrick Street at the Tennessee Performing Arts Center 505 Deadrick Street in Nashville, Tennessee; and
WHEREAS, The Metropolitan Government of Nashville and Davidson County ("the Metropolitan Government") supports this proposal and believes that it will be an enhancement to the public right- of- way and will benefit the public interest; and
WHEREAS, entering into the attached agreement with the State of Tennessee for implementation of these improvements within the right-of-way is in the best interests of the Metropolitan Government,
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. The attached agreement with the State of Tennessee is approved; and the Metropolitan Mayor is authorized to execute said agreement.
SECTION 2. This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
