ORDINANCE NO. BL2002-1119

An ordinance accepting an easement from Belmont University with a provision to abandon the sewer line in the future. Project No. 99-SG-244.

WHEREAS, BL2001-753 authorized the acquisition of property by negotiation or condemnation of Parcels 104-16-340 and 104-16-331 owned by Belmont University; and

WHEREAS, Belmont University agreed to give easement 2-3 and 3-3 to the Metropolitan Government conditioned upon the future abandonment of said easements should Belmont University purchase Map and Parcel No. 104-16-341; and

WHEREAS, Metropolitan Government will no longer need easements 2-3 and 3?3 in the event Belmont University acquires Map and Parcel No. 104-16-341.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the attached easements are hereby accepted and agreed to by the Metropolitan Council with the provision that the easements will be abandoned in the event that Belmont University purchases 1500 Ashwood Avenue, Map & Parcel 104-16-341.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
