ORDINANCE NO. BL2001-716

An ordinance authorizing the Metropolitan Mayor to execute an agreement with W. L. Hailey, Inc., accepting a 48" sewer relocation at 4th and Chestnut and a five (5) year maintenance of the Mill Creek Trunk Sewer in exchange for a release of obligation to correct the deficient gradient on the Mill Creek Trunk Sewer.

WHEREAS, HAILEY, acting under contract with METRO, constructed an extension of the Mill Creek Trunk Sewer known as Project No. 87-SG-100; and

WHEREAS, HAILEY agrees that a portion of that 30-inch sewer was constructed by them with a flatter gradient than was specified on the plans; and

WHEREAS, such a condition results in less hydraulic capacity in this sewer than was anticipated and may also necessitate increased maintenance; and

WHEREAS, the correction of this gradient problem will be expensive and will likely be unnecessary until some point in the future when and if the growth of the community requires more hydraulic sewer capacity; and

WHEREAS, METRO desires to relocate an unrelated section of a 48-inch sewer at 4th and Chestnut which is presently under a building and thus inaccessible for proper maintenance, plans for which are identified as Project No. 99-SG-160; and

WHEREAS, both HAILEY and METRO desire to reach an accord which will satisfy the needs of both parties and our community.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute the attached agreement with W. L. Hailey, Inc. on behalf of the Metropolitan Government and to accept the 4th & Chestnut Avenue Sewer Project, Metro Project No. 99-SG-160.

SECTION 2: That future amendments to this agreement shall be made by Resolution, approved by the Metropolitan Council, authorizing the Mayor to sign such amendments.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
