ORDINANCE NO. BL2001-713

An ordinance authorizing the Metropolitan Mayor to execute an agreement with the Nashville Electric Service for the Department of Water and Sewerage Services to lease electrical power facilities at the Central Wastewater Treatment Plant Complex.

WHEREAS, the Nashville Electric Service (NES) leases electric equipment serving the Central Wastewater Treatment Plant Complex; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services (MWSS) is working to reduce the cost of electrical power to operate its water and wastewater facilities in Davidson, Wilson and Williamson Counties; and

WHEREAS, NES, Tennessee Valley Authority and MWSS have initiated a Variable Price Interruptible Power Product which provides large power users an opportunity to obtain a lower power cost; and

WHEREAS, NES has offered MWSS the opportunity to lease its electric facilities at Central Wastewater Treatment Plant Complex at a monthly facility rental charge of $133.91.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the Metropolitan Mayor or his designee is hereby authorized to execute a lease agreement with Nashville Electric Service for facilities at the Central Wastewater Treatment Plant Complex as contained in Exhibit A after prior approval by the directors of Water Services, Finance and Law.

Section 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
