ORDINANCE NO. BL2001-701

An ordinance approving a contract from the Tennessee Department of Transportation concerning signalization at Stewarts Ferry Pike at I-40 Eastbound exit ramp, Project No. LP 3092.

Whereas, The Metropolitan Government of Nashville and Davidson County in recognition of the benefits to be received from the installation of Traffic Signals by the Tennessee Department of Transportation, desires to cooperate with the Department such that the signals may be installed, operated and maintained;

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1. The contract by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County providing for the signalization at Stewarts Ferry Pike at I-40 eastbound exit ramp in Metropolitan Nashville and Davidson County, Project LP 3092, a copy of which is attached hereto and incorporated by reference, is hereby approved.

Section 2. The Metropolitan Government shall maintain signals and be responsible for the cost related to the furnishing electrical current thereto.

Section 3. The Metropolitan County Mayor is authorized to execute future agreements necessary for the implementation and completion of Project No. LP 3092, which agreements shall become binding on the Metropolitan Government upon ratification by Resolution supported by 21 affirmative vote of the Metropolitan County Council

Section 4. Should any court of competent jurisdiction declare any section, clause, or provision of this ordinance to be unconstitutional, such decision shall affect only such section, clause or provision so declared unconstitutional, and shall not affect any other section, clause or provisions of this ordinance, it being the express intent of the Metropolitan County Council of The Metropolitan Government of Nashville and Davidson County that the remainder of this ordinance continue in full force and effect.

Section 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
