ORDINANCE NO. BL2001-691

An ordinance approving and authorizing the Director of the Department of Parks and Recreation to execute an agreement accepting the donation of a parcel of property from JDN Realty Corporation for use as part of the park and greenway system.

Whereas, the Metropolitan Government owns and operates a system of parks and greenways; and

Whereas, pursuant to the terms of the agreement (the "Agreement") attached to this ordinance as Exhibit A and the warranty deed attached thereto, JDN Realty Corporation proposes to improve and donate a parcel of property in Davidson County (the "Property") to the Metropolitan Government for use as part of the park and greenway system; and

Whereas, approval of the Agreement and acceptance of the donation of the Property, contingent upon satisfactory completion of the improvements contemplated by the Agreement, will benefit the citizens of Davidson County by enhancing the quality and availability of recreational opportunities in Davidson County.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Director of the Department of Parks and Recreation is hereby authorized to execute the attached Agreement between The Metropolitan Government of Nashville and Davidson County and the JDN Realty Corporation.

Section 2. That the donation of the Property is accepted, contingent upon satisfactory completion of the improvements contemplated by the Agreement, as evidenced by a certification to that effect delivered to the Metropolitan Clerk by the Director of the Department of Parks and Recreation.

Section 3. That any amendments, renewals or extension of the terms of the Agreement must be approved by resolution of the Metropolitan Council.

Section 4. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2001-691

Mr. President:

I move to amend Ordinance No. BL2001-691 by substituting the Agreement and Special Warranty Deed, attached to this ordinance as Exhibit A, to reflect the revised Subdivision Plat to be recorded in the Register's office.
