ORDINANCE NO. BL2001-690

An ordinance authorizing a participation agreement between Phillips Builders, Inc., hereinafter known as "PHILLIPS BUILDERS" and the Metropolitan Government, Department of Water and Sewerage Services, hereinafter known as "METRO" for the construction, operation and maintenance costs of the Wyntergrace Farms Pump Station and Force Main, Project No. 99-SL-238.

WHEREAS, PHILLIPS BUILDERS has expressed a desire to provide a public pressure sewer extension to serve the development; and

WHEREAS, it is deemed in the best interest of both parties to construct Wyntergrace Farms Pump Station and Force Main, and PHILLIPS BUILDERS agrees to solely fund the total construction costs of the pump station and fund additional operation and maintenance costs for the pump station and force main; and

WHEREAS, this project is identified in Metro's 1999-2000 Capital Improvements Budget as Project No. 96SG0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to accept from PHILLIPS BUILDERS the amount of $111,000.00 for the construction, operation & maintenance of the pump station and force main. The attached agreement details the payment terms and requires PHILLIPS BUILDERS to pay the total cost for the pumping station construction.

SECTION 2: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
